In a decision dated April 19, 2021, a five-member panel of the Supreme Administrative Court (SAC) definitively upheld the repeal of specific provisions of Ordinance N-18. The appellants were the Bulgarian Chamber of Commerce, the Bulgarian Association of Restaurants, and more than 40 other business organizations and companies. The Savov & Partners team drafted the appeal and provided legal representation before both court instances (a three-member and a five-member panel of the SAC).
As a result of the Supreme Administrative Court’s decision, there remain gaps in the legal framework governing sales reporting at retail outlets, the requirements for the Specialized Sales Point Terminal (SUPTO), and the operations of online stores—gaps that further underscore the need for a comprehensive overhaul of the Ordinance’s concept and the introduction of software-based fiscalization.
